Terms of Service
Last updated: November 1, 2026
These Terms govern the RoofReplacementLakeland.com website and its referral phone line. Any roof work is arranged directly between you and an independent contractor, under that contractor's own estimate, contract and warranty terms.
1. Acceptance and Scope
These Terms of Service ("Terms") are an agreement between you and RoofReplacementLakeland.com ("the site," "we," "us," or "our"). They cover roofreplacementlakeland.com, its referral phone line, and related email communications (together, the "Services").
By using the Website or referral line, you accept these Terms and our Privacy Policy. If you do not accept them, please do not use the Services. You must be at least 18 and able to enter a binding agreement. If you call for a landlord, property manager, homeowners association, business or other organization, you confirm that you have authority to speak for it.
2. Roofing Information and Referral Calls
The Website offers general roofing information and a phone line that connects callers with independent roofing contractors serving Lakeland, Florida. This site is not a contractor and performs no roof work. Calling the number, being connected, or receiving an email reply does not create a contract, reserve an inspection, set a price, or promise that a contractor will be available or able to fix a problem.
Inspection times, scope of work, materials, pricing, permits, warranties, payment terms and insurance paperwork are agreed directly between you and the contractor who takes your call. Contractors are independent businesses, not employees or agents of this site. Before any work starts, check the business and its qualifying individual on the Florida DBPR "Verify a License" search, and confirm that the contractor will pull the City of Lakeland roofing permit.
You agree to give accurate contact, property and roof details when you call or email, and to correct them if they change. If you are not the owner, you are responsible for getting the owner's or manager's permission before arranging an inspection or sharing their information.
3. Safety and Emergency Limitations
The Website is not an emergency service and should not be relied on for real-time safety instructions. If a roof or ceiling is sagging or collapsing, water is reaching wiring or light fixtures, a tree has struck the house, power lines are down, or there is fire or another immediate hazard, move people away and call 911, the fire department, the electric utility or another emergency authority.
General information on the Website does not replace an on-site roof inspection by a licensed contractor. Do not climb onto a wet, steep or storm-damaged roof, walk on tile, work near power lines, or attempt any repair beyond your training based only on Website content.
4. Privacy and Electronic Communications
Our Privacy Policy explains how information is collected, used, shared, kept and protected. When you call the referral line, your number and ZIP area are passed to the contractor who takes the call, and that contractor may contact you about your roof by phone or email. Calling does not mean agreeing to marketing.
You are responsible for carrier, internet and device charges. Calls may be recorded, and email can be delayed, filtered or misdirected, so do not send highly sensitive information by email.
5. Acceptable Use
The Services may be used only for lawful purposes. You must not:
- Place false, fraudulent, harassing or unlawful calls or messages, or impersonate anyone.
- Send spam, robocalls, automated traffic, malicious code, or an unreasonable volume of requests.
- Probe, scan or bypass security measures, access controls or rate limits.
- Reach data or systems without permission, or disrupt the Services, the call line, networks or other users.
- Scrape, copy, frame, republish or commercially exploit the Services unless the law or written permission allows it.
- Use the Services to create safety hazards, invade privacy, infringe intellectual property, or support illegal activity.
6. Website Content, Intellectual Property, and Your Messages
The Services, name, design, text, graphics, photographs, code and other materials belong to us or our licensors and are protected by intellectual-property law. You may view and use Website content for personal or property-management purposes connected with understanding roof problems or finding a roofing contractor. All rights not expressly granted are reserved.
You keep ownership of anything you send us. You give us a non-exclusive, worldwide, royalty-free license to store, copy, transmit and use it only as reasonably needed to run the Services, answer your message, route your call, keep records, protect the Services and follow the law. You confirm that you have the rights needed to share what you send.
Suggestions or feedback sent without a separate confidentiality agreement may be used freely and without payment, while any personal information that comes with them is handled under the Privacy Policy.
7. Third-Party Services and Links
The Services rely on or link to hosting, call-tracking, email, mapping, font and other providers, and calls are answered by independent roofing contractors. We do not control their availability, content, security, terms, privacy practices or decisions. A link or connection is not an endorsement.
Your dealings with a contractor or other third party are governed by its own terms. To the fullest extent the law allows, we are not responsible for a contractor's or third party's work, estimates, materials, statements, warranties or data practices.
8. Disclaimers
To the fullest extent the law allows, the Services are provided "as is" and "as available." We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, error-free operation and security. We do not warrant that Website information is complete or current, that a contractor will answer, or that a call will be connected within any particular time.
Every roof is different. Photos, descriptions, maintenance tips and examples are illustrative only and are not a diagnosis, estimate, code or permit determination, insurance opinion, warranty, or statement about a specific property.
Some places do not allow certain warranty exclusions. Where that is the case, these exclusions apply only as far as the law permits.
9. Limitation of Liability and Indemnification
To the fullest extent the law allows, RoofReplacementLakeland.com and its owners, affiliates, personnel, licensors and service providers are not liable for indirect, incidental, special, exemplary, punitive or consequential damages, lost profits, lost data, business interruption, property damage, roof or water damage, or personal injury arising from use of or inability to use the Website or referral line, reliance on general Website content, any contractor's work or advice, a third-party service, or unauthorized access, even if told such harm was possible.
To the fullest extent the law allows, our total liability for claims arising only from use of the Website or referral line is limited to proven direct damages. This limit does not alter liability that cannot lawfully be limited or any contractor agreement.
You agree to defend, indemnify and hold the protected parties harmless from third-party claims and reasonable costs that result from your unlawful use, a breach of these Terms, infringement of someone else's rights, or sharing information you had no authority to share. This duty does not apply where a claim results from our own unlawful conduct.
10. Suspension, Termination, and Discontinuation
Access to the Services may be suspended or ended when reasonably needed to deal with a violation, security risk, legal requirement, abuse or operational problem. You may stop using the Website whenever you choose. Terms that by their nature should continue, including ownership, disclaimers, liability limits, indemnification and dispute terms, survive termination.
We may change, pause or discontinue all or part of the Website or the referral line.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where federal law or mandatory consumer law applies. Before filing a claim, you agree to contact us first and try in good faith to settle the dispute informally for at least 30 days.
Unless the law requires otherwise, any claim relating to these Terms or the Services must be brought in the state courts located in Polk County, Florida, or the federal court with jurisdiction over Polk County, and each party consents to personal jurisdiction there. Either party may still seek emergency injunctive relief or use a qualifying small-claims process.
12. General Terms
Changes
These Terms take effect on November 1, 2026. They may be revised, and a revised version applies once posted unless a later date is given. Using the Services after that date means accepting it.
Severability and waiver
If any provision cannot be enforced, it will be changed only as much as needed and the rest stays in effect. Not enforcing a provision does not waive it.
Assignment and entire agreement
You may not transfer these Terms without our written consent. We may transfer them as part of a reorganization, merger, sale or transfer of the Services. These Terms and the Privacy Policy are the whole agreement about the Website and referral line, but they do not replace any contract you sign with a roofing contractor.
Interpretation
Headings are for convenience only. "Including" means "including without limitation." Electronic acceptance and records carry the same weight as paper records where the law allows.
